These Terms of Use (“Terms”) govern your access to and use of Silent Hour, including the website, progressive web app (PWA), and native mobile applications (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Silent Hour provides mindfulness tools including phase-based sessions, journaling, goals, analytics, and breathing exercises. The Service is offered for personal, non-commercial wellness use unless we agree otherwise in writing.
2. No medical advice
Silent Hour is not a medical device and does not provide medical, psychological, or therapeutic advice. The Service is not a substitute for professional healthcare. If you have a health concern or emergency, contact a qualified provider or emergency services immediately.
3. Eligibility
You must be able to form a binding contract in your jurisdiction to use the Service. If you are under the age required in your country to consent to online services, you may use the Service only with permission from a parent or guardian.
4. Your data and privacy
Practice data (sessions, journals, goals, preferences) is stored locally on your device. We do not operate user accounts for the core app experience. Our data practices are described in the Privacy Policy and Cookie Policy. You are responsible for backups you create and for securing your device.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse engineer, scrape, or disrupt the Service
- Introduce malware or interfere with other users’ access
- Misrepresent your affiliation with Silent Hour
- Use the Service in a way that violates applicable app store policies
6. Intellectual property
The Service, including its design, text, graphics, audio synthesis, and software, is owned by the Silent Hour project or its licensors and protected by applicable laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal purposes. You retain ownership of content you create in the app (e.g., journal entries).
7. Free service
Silent Hour is currently provided free of charge with no in-app purchases or subscriptions. We may change pricing or features in the future with notice where required by law or platform rules.
8. Third-party platforms
If you download the app from Google Play or the Apple App Store, those platforms’ terms and policies also apply to your use of their distribution services. We are not responsible for third-party platform actions.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILENT HOUR AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (TYPICALLY ZERO FOR A FREE APP).
11. Indemnification
You agree to indemnify and hold harmless Silent Hour and its contributors from claims arising out of your misuse of the Service or violation of these Terms, to the extent permitted by law.
12. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after changes constitutes acceptance of the revised Terms.
13. Termination
You may stop using the Service at any time by uninstalling the app or ceasing use of the website. We may suspend or discontinue the Service where permitted by law or platform requirements.
14. Governing law
These Terms are governed by the laws applicable in your place of residence or the jurisdiction where the Service operator is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
